Hearing impaired man pursued, tased in his own garage, pursues federal civil rights lawsuit


Background

Dan Spence was driving home when Delphos police officer Klingler stopped him for an alleged traffic violation. After ticketing Dan, Klingler pursued Dan to his own home. Dan is hearing impaired and reads lips to assist him in communicating, a fact known to Klingler. As Dan walked into his garage to turn on lights so he could see Klingler's mouth, Klingler tased him unnecessarily, causing him pain and injury.


Approach & Resolution

Dan filed a federal civil rights lawsuit seeking damages for the pain and suffering Officer Klingler caused him. 

The City of Delphos agreed to pay Dan $150,000 to resolve his claims.
